Tree roots damage driveway in preston

Tree root driveway damage is a common problem for homeowners in Preston, particularly in South Preston, Penwortham, Walton-le-Dale, Bamber Bridge, Lostock Hall, and Fulwood, where mature trees often sit close to driveways and property boundaries. Left unchecked, roots can lift paving slabs, crack tarmac, and even affect drainage, creating practical headaches and potential neighbour disputes. Understanding who is responsible and what steps you can take is essential to protect your property and maintain good relations with neighbours.

At LES Tree Services, our qualified tree surgeons in Preston provide professional tree care, tree maintenance, and local tree services to ensure your trees are safe and healthy. Early detection of hazards is key, as preventable problems can escalate quickly when inspections are delayed.

As a trusted tree surgeon in Preston, we regularly help homeowners understand their rights, responsibilities, and the safest way to manage problematic roots without falling out with the neighbour next door. Here’s a clear guide on what to do when tree roots damage driveways, who’s legally responsible, and when it’s time to call in a professional.

Why Tree Roots Cause Driveway Damage

Many homes in South Preston sit on older plots with long-established trees. As these trees mature, their root systems expand in search of moisture, often shifting soil, lifting tarmac, and cracking paving slabs.

Common signs of driveway root intrusion include:

  • Uneven, lifted or cracked paving
  • Small fissures spreading across tarmac
  • Blocked or damaged drainage nearby
  • Tree roots visibly surfacing

Species such as sycamore, poplar, willow, and oak—common throughout Preston—are especially known for aggressive, wide-spreading root systems.

Who Is Responsible for Tree Root Damage?

The main cause of friction is usually this question: Who pays when a neighbour’s tree damages your driveway?

  1. If the tree belongs to your neighbour

If roots spread across the boundary and damage your property, your neighbour may be liable – but only if you can show they were negligent. Negligence usually means:

  • They ignored repeated warnings
  • They refused to maintain a known problem tree
  • The tree was visibly unsafe or poorly maintained
  1. If the tree grows on your property

You’re responsible for damage caused to surrounding properties or public walkways. Local councils in areas like South Ribble and Preston City are strict about safety near footpaths and shared access driveways.

  1. Shared boundaries

If the tree sits exactly on the boundary, it’s considered jointly owned. Both parties share responsibility – and decision-making.

Can You Cut Back a Neighbour’s Tree Roots in Preston?

Yes – but only up to your boundary line, and only if doing so won’t make the tree unsafe. This is where disputes arise, especially in tight suburban streets around Penwortham, Walmer Bridge, and Broadgate.

Cutting roots can destabilise the tree. If root pruning causes the tree to fall or die, you may become liable for the damage. This is why it’s crucial to seek a qualified tree surgeon in Preston before doing anything drastic.

When to Call a Tree Surgeon (Preston Residential Properties)

You should consider contacting a professional tree surgeon when:

  • Your driveway is showing cracks or lifting due to roots
  • A neighbour’s tree is encroaching and needs safe, legal pruning
  • You’re unsure who owns the tree
  • The tree is large, mature, or near power lines
  • The tree is protected by a Tree Preservation Order (TPO)
  • You need guidance for neighbour discussions or understanding legal limits

A certified tree surgeon in Preston can safely carry out work without breaching regulations or harming the long-term stability of the tree.

What to Do If a Neighbour’s Tree Is Damaging Your Driveway

  1. Document the Problem

Take photos, keep dated notes, and gather evidence of damage. This is essential if the issue becomes a legal or insurance matter.

  1. Speak to Your Neighbour

Approach the conversation calmly. Most disputes in Preston can be resolved with a friendly chat. Explain what you’ve noticed and ask whether they’ve had maintenance done recently.

  1. Seek Professional Advice

A neutral, knowledgeable opinion helps avoid conflict. Many homeowners around South Preston rely on expert guidance to understand what’s safe, legal, and necessary.

  1. Check for TPOs or Conservation Areas

Parts of Walton-le-Dale, Avenham, and Winckley are conservation areas. Removing or pruning a protected tree without permission can lead to fines.

  1. Involve Your Home Insurance if Necessary

Some policies cover driveways damaged by tree roots. Your insurer may require evidence of damage and documentation of the situation.

  1. Only Take Action Within Legal Limits

You can trim roots to your boundary, but if doing so risks tree failure – or if the tree becomes unsafe – you must involve the owner or the council.

How a Preston Tree Surgeon Can Help Protect Your Driveway

A professional service can provide:

  • Root pruning without destabilising the tree
  • Root barrier installation to protect driveways long-term
  • Tree thinning or reduction to limit root spread
  • Tree removal (if permitted and necessary)
  • Advice on legal and practical options when dealing with encroaching roots

Working with a local specialist ensures the work meets BS3998 tree work standards and accounts for Preston’s clay-based soils, which expand and contract seasonally – enhancing root movement.

Frequently Asked Questions About Tree Root Damage

Q: Can I cut a neighbour’s tree roots in Preston without asking them?

You can trim roots back to the boundary, but you must not make the tree unsafe. It’s recommended to notify your neighbour and consider professional advice first.

Q:Who pays if tree roots damage a shared driveway?

If a tree is jointly owned or sits on the boundary, responsibility may be shared. Discussing the issue early helps prevent disputes.

Q:Will insurance cover driveway damage from tree roots?

Some policies do, but they may require evidence of damage, records, and proof that the issue wasn’t caused by neglect.

Q: Can tree roots keep growing after pruning?

Yes. Roots regenerate, which is why barriers or ongoing maintenance might be needed.
